Digital Radio & News Terms and Conditions
Agreement to Terms
These Terms and Conditions (the “Terms”) form a legally binding agreement between you and YHH IT Solutions (“we”, “us”, “our”) governing your access to and use of Digital Radio & News on Android and iOS (the “App”). They take effect on November 30, 2025.
Our Privacy Policy is incorporated into these Terms by reference. In these Terms, “you” means the person using the App.
Acceptance of Terms
By downloading, accessing, or using Digital Radio & News, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use Digital Radio & News.
Eligibility and Age Requirements
You must be at least 4 years old (or the age of digital consent in your jurisdiction, whichever is greater) to use Digital Radio & News. By using it, you represent that you meet this requirement and have the legal capacity to enter into this agreement.
License to Use the App
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Digital Radio & News for your personal, or internal business, use. This license depends on your compliance with these Terms, and we reserve all rights not expressly granted.
Your use of Digital Radio & News on Apple devices is also subject to Apple’s Licensed Application End User License Agreement (Apple’s standard EULA).
What the App Provides
Digital Radio & News is a player and reader for content that other people publish. It lets you tune in to live radio streams operated by broadcasters, browse news articles published by news organisations, save favourites, and record a broadcast to listen to later.
We do not produce, own, control, or endorse that content, and we do not guarantee that any particular station, article, or feature will remain available. Stations go off air, change their stream addresses, or restrict access by region; publishers remove articles. We may add, change, or withdraw features at any time.
Streaming radio and opening a full article require an internet connection. You are responsible for your own data charges.
Digital Radio & News does not display advertising, and there is nothing to buy inside it. It has no accounts: you do not sign in, and we hold no profile for you.
Recordings and Personal Use
The App can record a broadcast you are listening to. Recordings are saved on your own device and are never uploaded to us.
Broadcasts are protected by copyright and by the broadcaster’s own terms. You may record only for your own private, non-commercial listening, and only where the law of your country permits it. You must not reproduce, publish, broadcast, sell, or otherwise distribute a recording without permission from the rights holder. You are solely responsible for how you use what you record.
Because recordings live only on your device, they are your responsibility to keep: uninstalling the App or losing the device loses them, and we cannot recover them.
Acceptable Use
You agree not to:
- use Digital Radio & News for any unlawful or unauthorised purpose;
- violate the rights of others, including intellectual-property and privacy rights;
- redistribute, rebroadcast, or publicly perform any stream, article, or recording obtained through the App;
- reverse-engineer, decompile, or attempt to extract the source code of the App, except where the law expressly permits;
- copy, resell, rent, sublicense, or commercially exploit the App without our permission;
- use bots, scrapers, or other automated means to access the App;
- interfere with, overload, or disrupt the App, its servers, or its security, or those of any broadcaster or publisher reached through it;
- attempt to gain unauthorised access to any account, system, or network;
- upload or transmit malware or other harmful code;
- impersonate any person or misrepresent your affiliation with anyone.
We may investigate suspected violations and take action, including suspending or terminating your access.
Third-Party Content and Services
Radio streams and news articles come from independent third parties. Your use of their content is subject to their own terms, and any dispute over that content is between you and them. We are not responsible for its accuracy, legality, or suitability, and content available in one country may not be available in another.
Digital Radio & News relies on third-party services — Google Firebase for analytics, crash reporting, push notifications, and remote configuration — that operate under their own terms and privacy policies. See the “How We Share Information” section of our Privacy Policy.
Intellectual Property
Digital Radio & News — including its software, design, user interface, graphics, text, logos, and trademarks — is owned by YHH IT Solutions or its licensors and is protected by intellectual-property laws. No rights are granted to you except the limited license described above. You may not use our name or logos without our written permission.
Station names, logos, article text, and broadcast audio belong to their respective owners. Nothing in these Terms transfers any right in that material to you.
Third-Party Links
Digital Radio & News may contain links to third-party websites, services, or resources that we do not control, and opens publisher pages in an in-app browser. We provide them for convenience only and are not responsible for their content or practices. Using them is at your own risk and subject to their terms.
Disclaimer of Warranties
DIGITAL RADIO & NEWS IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT DIGITAL RADIO & NEWS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY STATION OR ARTICLE WILL BE AVAILABLE, OR THAT ANY RECORDING WILL COMPLETE OR BE RETAINED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YHH IT SOLUTIONS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, RECORDINGS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE DIGITAL RADIO & NEWS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH, PERSONAL INJURY, OR FRAUD.
Indemnification
You agree to indemnify, defend, and hold harmless YHH IT Solutions, its affiliates, and their respective officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of Digital Radio & News, your violation of these Terms or any law, or your infringement of any third-party right.
Termination
You may stop using Digital Radio & News at any time by uninstalling it. We may suspend or terminate your access, with or without notice, if you breach these Terms, for legal or security reasons, or if we discontinue Digital Radio & News. When your access ends, the license granted to you ends and you must stop using the App. Sections that by their nature should survive — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — survive termination.
Governing Law and Disputes
These Terms are governed by the laws of Nepal, without regard to its conflict-of-law rules. The courts of Nepal have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law in your home country gives you the right to bring proceedings there.
Before starting any formal claim, you agree to contact contact@yhhits.com and try to resolve the dispute informally for at least 30 days.
Changes to These Terms
We may update these Terms from time to time. When we do, we revise the effective date above and post the updated Terms in the same place. For material changes, we give reasonable notice in the App. Your continued use of Digital Radio & News after the changes take effect means you accept them.
Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy Policy, are the entire agreement between you and YHH IT Solutions regarding Digital Radio & News and replace any prior agreements. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets.
App Store Terms
These Terms are between you and YHH IT Solutions, not Apple. Apple has no obligation to provide support or to handle any warranty claims relating to Digital Radio & News. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. embargo and are not on any U.S. list of prohibited or restricted parties.
Your use of Digital Radio & News obtained through Google Play is also subject to the Google Play Terms of Service.
